Europakommissionen anser inte att demonstrationer mot ACTA är demokratiska

Europakommissionen, de anser tydligen att den lobbyverksamhet som fåtalet hemställt till dem i ett brev, är mer demokratiskt än de tusentals enskilda individer som har demonstrerat mot ACTA. Jag och andra har tidigare skrivit om lobbybrevet som cirkulerat i europaparlamentet [Beelzebjörn] [Hanna Friden]. Vad som nu visar sig i en läckt mötesutsaga från kommissionen, är enbart mer av detsamma, den totala världsfrånvändhet som råder i den politiska toppen [Techdirt]

"Netzpolitik.org points us to leaked internal minutes of a meeting of the European Commission the day before the massive Europe-wide demonstrations against ACTA. They reveal the EU's top politicians taken aback by the scale of the planned demonstrations, but dismissing them with almost the same words as the IFPI (German original):"

 Europas toppolitiker förstår inte vidden och skalan på de protester som nu pågår, de ser inte att det är värkliga farhågor. Förhandlingarna bakom ACTA hör till de mest odemokratiska projekt som förekommit, där ett fåtal har haft insyn i de hemliga dokumenten och förhandlingarna, det har inte varit folkvalda parlamentariker som har haft tillträde. Det har varit samma företag som kallar demokratiska yttringar för ett hot mot demokratin, det säger mer om hur nära industrien står politikerna och hur lite de demokratiska processerna egentligen betyder. Demokratin ska i deras värld vara just för fåtalet, när det är det enda de känner till och har erfarenhet av. Det är allvarligt när politikerna inte ser skillnaden på sitt ämbete och sin privatroll och de kommer att sammanblandas. Det kallas med andra ord för korruption. Europadomstolen ska nu få granska ACTA-avtalet [SvT], om det är förenligt med EU rätt och de mänskliga friheter vi anser oss ha. Vi har rättigheter och de rättigheterna måste vi hålla på, i en allt mer politiskt  repressiv miljö blir det till en absolut nödvändighet.

Är man kritisk mot ACTA-avtalet, är man mot demokrati

Det är i princip vad som står i ett gemensamt utskick, från olika lobbyistorganisationer. De menar att alla utom dom förstås innehar det sanna ordet, företag som redan har investerat stort i ACTA-avtalet och att det går igenom oavkortat. Det är samma företag som har förhandlat fram detta, som nu påstår att kritiker till avtalet, skulle vara mot öppenhet och transparens. Öppenhet och transparens vilket demokrati innebär, eller borde innebära. Men dessa företrädare för stora ekonomiska intressen, är samma som de vilka har drivit fram avtalet i hemlighet, i hemliga förhandlingar. Vänder länder ryggen till, när de har en annan uppfattning och driver likväl hänsynslöst vidare. Avtalet som skulle vara till ett skydd för livsviktig industrinäring i länder under utveckling, riskerar därmed att lämnas utanför som en paria.

Please support ACTA for the good of Europe"
Dear Member of the European Parliament,

Over the past two weeks, we have seen coordinated attacks on democratic institutions such as the European Parliament and national governments over ACTA. The signatories to this letter and their members stand against such attempts to silence the democratic process. Instead, we call for a calm and reasoned assessment of the facts rather than the misinformation circulating. A considered reaction is more important than ever at a time when many outside of Europe doubt the ability of the European Union institutions and its Member State governments to act together.
The signatories of this letter represent thousands of European companies of all sizes and millions of workers in dozens of sectors crucial to the European economy, which are eager to get Europe out of the current economic crisis by promoting innovation and growth-enhancing measures. We are all dependent on intellectual property.
ACTA is good for Europe. Without changing EU law, it establishes common procedures for dealing with IPR infringements across countries accounting for 50% of world trade. The framework set up by ACTA will have a positive impact on protecting Europe’s industries, jobs and people. ACTA will have no negative consequences as it does not depart from EU law – as confirmed by three opinions of the European Parliament’s Legal Service as well as the European Commission. It is important to show that Europe is united and has trust in its institutions and government processes. That is why ACTA is supported by all the organisations and companies below, as well as 22 European Member States who joined the EU in the first step towards ratification.
We therefore urge you to focus on the facts and not the misinformation and to support ACTA. ACTA is an international cooperation project that will protect Europe’s rights and people and will confirm the EU’s global importance as a responsible trading partner. For Europe to have a successful knowledge economy and manufacturing base it must protect its workers, creators and the innovations of its manufacturers and industries abroad. The ACTA treaty sends an important message to third countries and to Europe’s workforce that our rights must be protected in practice, and that Europe will not fall behind other countries in this regard. This is a crucial moment for Europe’s governments and institutions in their effort to safeguard Europe’s jobs and economic future. Failure to do so will irrevocably affect Europe’s credibility as a trusted global trade partner.
 
Således inte ett ord om vare sig Brasiliens eller Sydafrikas behov, när. det är mer en fråga om att skydda fort europa och det egna egenintresset. Vad som skulle vara de riktiga fördelarna framgår inte.

Vilka koordinerade attacker då kan man fråga sig, men inget om vilka dessa odemokratiska krafter är framgår av brevet i sig. Är det vi som är kritiska? Frivilligorganisationer, politiskt aktiva. Är det vi som med odemokratiska medel söka tysta ned den demokratiska processen? Det är väl snarare de som skrivit under cirkulationsbrevet och skickat ut detta i hemlighet, till de demokratiskt valda i EU-parlamentet för att påverka. Inte i en öppen och transparent debatt, där de demokratiska verktygen finns samlade.
